Press Release on Ill-Treatment Detected by our Institution

The Human Rights and Equality Institution of Türkiye conducted an unannounced visit to Gaziantep Removal Center on 04.08.2022 within the scope of the national preventive mechanism mandate.

During the interviews conducted by the visiting delegation, consisting of HREIT officials, a doctor and a psychologist, four foreigners under administrative detention alleged that they were ill-treated by two private security guards.

Following the allegations, the security camera recordings of the relevant day and time were examined by the visiting delegation and witnesses were heard. During this process, the authorities of the Removal Center worked in cooperation with the visiting delegation. The investigation revealed that two private security guards inflicted non-repetitive short-term physical violence on four foreigners at the Center. An immediate investigation was launched by the Center authorities against the security guards concerned. The security guards were suspended and their employment contracts were terminated. At the same time, the HREIT was informed that a criminal complaint was filed by Gaziantep Provincial Directorate of Migration Management to Gaziantep Chief Public Prosecutor’s Office on 05.08.2022.

According to the fifth paragraph of the 18th article of the Law No. 6701, “In cases where the Board finds any violation of human rights or non-discrimination of a criminal nature, it shall file a criminal complaint thereon.”

According to second paragraph of 101th article of the By-Law on the Principles and Procedures for the Implementation of Law on the Human Rights and Equality Institution of Türkiye, “In case of violation of human rights or prohibition of discrimination which constitutes the offense during the on-site examination, a criminal complaint shall be filed with the decision of the Board. Necessary violations are requested to be taken with immediate removal of such violations.”

Within the framework of the issues explained above, the HREIT also filed a criminal complaint with the Gaziantep Chief Public Prosecutor’s Office regarding the ill-treatment detected by the visiting delegation.
